I have submitted all the necessary documents to Scorpion in order to help me with the above matter, my policy payment it’s always upto date yet I have received the out come that doesn’t please me at all I once appear at CCMA with the lawyer referred to me by Scorpion, the Official at CCMA took the side of the company after this company unfairly retrenched me as per their say All the documents was submitted to back my case, now the outcome of this case was not to my satisfaction, as they mention that I have assumed to be retrenched On the 4 February 2018 I got a call from the owner of the company which I was working that on the 5 February 2018 to report at his office of which I did, on my arrival this owner had a documents with him from Labour department, he asked me why I didn’t resolve the matter within the office, I told him that ever since I worked for his company every Month ther will be a shortage in my pay and did complain with his HR without success, This owner tald me straight that I have to come on the 7 February2018 to sign retrenchment documents as he doesn’t have any choice but to retrenche me He gave me the notice to appear for the retrenchment consultation on the 7th February 2018 The notice wanted me to sign on it, I didn’t sign, that is when this owner tald me that I mustn’t go to work and I must bring back his uniform I took that notice and went home, on the 7 February 2018 I went back to his office with his uniform, he ordered Fannie and Emma to give me a letter, on that letter it was written all the amount to get from the as a retrenchment benefits, When I counted my provided fund I contribute to the company, it was far lesser than what I did contributed, That where it raises my consciousness that I don’t have to sign that document They asked me if I don’t sign that document I just have to make sure that i don’t go out side their office with either a copy of if, I did manage to asked one of the cleaner to make a copy for me and she did help me They told me that since I don’t want to sign I can the office and leave their uniforms I reported the matter at Roodepoort Scorpion branch All the documents was send to The lawyer I was referred to, retrenchment UI19 from this company was also send to the lawyer even I got it after the case was submitted to this lawyer I will like to be urgently assisted with this case as I feel that I was unfair retrenched, and the CCMA was unfairly over rule this case and Scorpion it’s failing it’s clients because even myself I wasn’t convinced by the way the lawyer represented Me during our appearance at CCMA Kindly review this case and relook all the factors of this case, because firstly this company didn’t held any consultation with me Secondly the very same day on the 7th February 2018 company hired someone on my space and even now he is still working there for this company on my position During the last 6months I have been receiving the money from Labour department with same UI19 retrenchment documents that I got from this company Please review the case as I am totally not happy about its outcome
