After a female patient alleged that Machala removed her dressing and caressed her during her massage; Mark Evan Machala’s medical license was suspended by Oregon Board of Chiropractic Examiners.
However Machala’s lawyer, Garren Pedemonte, argued that the incident was out of sheer misunderstanding as Machala supposed that the woman was welcoming his sexual advances towards her. The complied reports of the board and the Ashland police states that Machala deviated from massage treatment of the victim and started caressing her. According the victim she opened her eyes as she found Machala fondling her breasts and nonchalantly apologized for doing so.
Although Machala tried to calm down the situation by several means, the victim filed a complaint in the police. According to the victim she felt sick after she learnt that Machala is a married man. Pedemonte further argued that the victim’s experience was an never-to -be-repeated one as no prior inappropriate relationships with clients were established by Machala. Machala’s licence was issued in November 2009 and since then there were no disciplinary action against this. This was his first criminal offence and a trial was set on 7Th December 2015 against him on a single misdemeanour charge of third-degree sexual abuse.
