Mr. Cahill cashed the check and refuses to give me back my deposit. I can not get financing. He stated deposit is non refundable. I am 65 yrs old, on disability and no way would I have given a $5000 check if I were not going to get it back. How do these people live with them selves by ripping a 65 yr old off of $5000. Met with Mark CaHill on Monday March 16th at approximately 7:30 pm at 4382 Indianola ave, Columbus Ohio to look at a used Cadillac Escalade. I advised Mr. CaHill that I was going to try to get financing as they stated that i needed my own as they do not finance outside of Columbus. I left Mr. Cahill a $5000 check for deposit contingent on getting finance. Never once did Mr. Cahill explain that they would keep the $5000. I did sign receipt but did not read it as Mr.Cahill stated here is receipt for your deposit. It was about 9:00 pm and I had a two hour drive home so i just folded it and put in my purse. The next morning I went to stop payment on check so it could not be cashed as I could not get financing. The check was already cashed and I could not put a stop payment on it. I called Mr. Cahill and texted him to let him know that i could not get financing and could he send my check back. He then stated that deposits are non refundable. First time he ever stated that . I advised Mr. Cahill that i would contact the attorney general’s office and he stated do what I have to do. They have refused to give me back my deposit and stated that their lawyer advised them not to talk to me. I am 65 years old, on disability and would never have left a $5000 check if I thought i was not going to get it back. Who in their righrt mind would do that. My money is too hard to come by and I am on a limited income. I can not believe that they would keep my check and expect that I would do nothing about it. I have a hard time believing that I am the only one that they have done this too. I am filing this in hopes that you can help me get back my $5000 by meeting with dealership. I really can not afford to lose this money.
