This is a warning to all good fathers. Please stay away from the law offices of Gina Smalley. Mrs. Smalley was assigned to be a Guardian Ad Litem in my upcoming custody and child support case. Mrs. Smalley rushed me in to do my initial consultation and drafted an intial intake report that was inaccurate. She collected $1500 and she could not be reached for nearly 11 months. For a year, I ran after Ms. Smalley pleading with her to do her job. I emailed her and called her asking her to conduct the home visits to my home and my ex wife’s home. I begged her to visit my child’s school that he was attending as well as the proposed school that my child would be attending if I secured full custody. I also provided her with a list of witnesses for her to contact in which she refused to contact. She stated that they would need to contact her. After a year of me calling and emailing, Mrs. Smalley finally came to my home and visited my child. She spent 30 minutes at my home, which is hardly enough time to make a determination as to the suitability of my home and my parenting. She indicated that she would return for subsequent visits which she did not. Mrs. Smalley never traveled to TN which is where my child’s mother lived, so she never got to see any interaction with my child and the mother nor did she ever get to visit my child at school and interact with teachers and principals. As a matter of fact, Ms. Smalley never interacted with my child’s mother at all except for the initial interview which was held over the phone instead of in person like my initial interview. Mrs. Smalley never heard from my child’s mother until 3 days before court. The GAL process lasted 18 months but there was no interaction between the two of them. Mrs. Smalley also showed up to court, testified about what she did not do and charged the parties an additional $5000 for attending the proceedings. Mrs. Smalley did my child a disservice by not doing her job. A GAL is suppose to protect the interest of children which requires them to do the research and determine what is in the best interest of the child. Mrs. Smalley developed a bias for my child’s mother because she did not hold Mrs. Smalley accountable for doing her job. I encouraged and expected Mrs. Smalley to interview witnesses, visit homes, visit schools, pull school reports, evaluate my son in both home environments, evaluate living arrangaments and make the best determination of custody based on what was best for my child. Mrs. Smalley failed my son, failed the family court system and failed me. The reality of the situation is Mrs. Smalley does not care about what is in the best interest of my child. Stay away form Mrs. Smalley and the law offices of Stearns Montgomery and Proctor who referred Mrs. Smalley to me. Their offices are within 1000 feet of each other and they have a partnership with each other designed to take advantage of fathers seeking full custody of their children.
